TERMS AND CONDITIONS OF SERVICE
SHIPTER — Peer-to-Peer Parcel Delivery via Delhi Metro

1. INTRODUCTION AND ACCEPTANCE OF TERMS
SHIPTER ("Company", "we", "our", or "us") is a technology platform that facilitates peer-to-peer parcel delivery through the Delhi Metro Rail Corporation (DMRC) network. We operate as an intermediary connecting individuals who wish to send parcels ("Senders" or "Customers") with verified metro travelers ("Traveler Partners") who are already traveling on the same metro route and are willing to carry parcels for a fee.
These Terms and Conditions of Service ("Terms") constitute a legally binding agreement between you and SHIPTER governing your access to and use of the SHIPTER mobile application ("App") and all services offered through it ("Services"). These Terms are an electronic record in accordance with the provisions of the Information Technology Act, 2000 and the Rules made thereunder.
By downloading, installing, registering for, accessing, or using the SHIPTER App or Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately uninstall the App and discontinue all use of our Services.
These Terms apply to all users of the SHIPTER App, including Senders, Customers, Traveler Partners, and any other persons who access or use the App in any capacity. SHIPTER reserves the right to modify, amend, or update these Terms at any time at its sole discretion. We will notify you of material changes through the App or by other means. Your continued use of the App after any such changes constitutes your acceptance of the revised Terms.
2. DEFINITIONS
For the purposes of these Terms, the following definitions shall apply:
"App" means the SHIPTER mobile application available on Android and iOS platforms.
"Sender" or "Customer" means any individual, firm, company, or organization that uses the SHIPTER App to book a parcel delivery service.
"Traveler Partner" means any individual registered on the SHIPTER App who has completed KYC verification and is eligible to accept and carry parcels on their Delhi Metro journey.
"Parcel" or "Consignment" means any item or package booked by a Sender for delivery through the SHIPTER platform.
"Delivery Request" means a request made by a Sender for delivery of a parcel between two DMRC stations.
"DMRC" means the Delhi Metro Rail Corporation, the operator of the Delhi Metro network.
"SHIPTER Wallet" means the digital wallet maintained by SHIPTER for each user to facilitate payments and earnings.
"Platform Fee" means the fee charged by SHIPTER for facilitating the connection between Senders and Traveler Partners, as displayed in the App from time to time.
"Earning" means the delivery charge paid by the Sender for a completed delivery, after deduction of SHIPTER's Platform Fee.
"KYC" means Know Your Customer verification, the process by which SHIPTER verifies the identity of Traveler Partners.
"OTP" means One Time Password, a time-sensitive numeric code used for secure verification of parcel pickup and delivery.
"Restricted Items" means items that are prohibited from being carried through the SHIPTER platform, as listed in these Terms.
"Services" means all services offered by SHIPTER through the App, including parcel booking, parcel delivery, wallet management, KYC verification, and customer support.
3. ELIGIBILITY AND REGISTRATION
3.1 Age Requirement You must be at least 18 years of age to use the SHIPTER App and Services. By using the App, you represent and warrant that you are at least 18 years of age. SHIPTER reserves the right to terminate accounts of users found to be under 18 years of age.
3.2 Account Registration To use the SHIPTER Services, you must create an account by signing in with your Google account and completing the profile setup process, including providing your full name and mobile phone number. You represent and warrant that all information provided during registration is true, accurate, current, and complete.
3.3 Account Security You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to notify SHIPTER immediately of any unauthorized use of your account or any other breach of security. SHIPTER shall not be liable for any loss or damage arising from your failure to maintain the security of your account.
3.4 One Account Per User Each user is permitted to maintain only one active account on the SHIPTER platform. Creating multiple accounts to circumvent any restrictions, bans, or policies is strictly prohibited and may result in permanent suspension of all associated accounts.
3.5 Traveler Partner Registration In addition to the standard registration requirements, Traveler Partners must complete the KYC verification process by submitting valid government-issued identity documents (Aadhaar Card and PAN Card) before they are eligible to accept Delivery Requests. SHIPTER reserves the right to approve or reject any Traveler Partner registration at its sole discretion without assigning any reason.
4. SERVICES OFFERED
4.1 Parcel Delivery via Delhi Metro SHIPTER's primary service is facilitating peer-to-peer parcel delivery through the Delhi Metro network. Senders can book a delivery by specifying the pickup DMRC station, drop DMRC station, parcel details, and receiver information. The SHIPTER platform then matches the Sender with a Traveler Partner who is traveling on the same metro route.
4.2 SHIPTER Wallet SHIPTER provides a digital wallet facility to all users. Senders can add money to their wallet using Razorpay (UPI, cards, net banking) and use it to pay for delivery services. Traveler Partners receive their earnings in the SHIPTER Wallet after successful delivery completion. Wallet balances can be withdrawn to a registered bank account subject to admin approval.
4.3 KYC Verification SHIPTER provides a KYC verification service for Traveler Partners to verify their identity and enable them to accept Delivery Requests and withdraw earnings.
4.4 Customer Support SHIPTER provides in-app customer support through a chat interface. Users can raise support tickets, report issues, and provide feedback through the App.
5. SENDER TERMS AND CONDITIONS
5.1 Booking a Delivery When booking a delivery, the Sender must provide accurate and complete information including the correct pickup DMRC station, drop DMRC station, receiver's name and phone number, accurate description of the parcel contents, estimated value of the parcel, and a clear photograph of the parcel. The Sender warrants that all information provided is true, accurate, and complete.
5.2 Physical Presence Requirement The Sender must be physically present at the pickup DMRC station at the time of booking and parcel handover. SHIPTER uses GPS verification to confirm the Sender's presence at the pickup station. Attempting to book a delivery while not physically present at the pickup station is a violation of these Terms.
5.3 Parcel Handover The Sender must hand over the parcel to the Traveler Partner only after verifying the Traveler Partner's identity through the App. The Sender must provide the pickup OTP to the Traveler Partner to confirm the handover. The Sender must ensure that the parcel is properly packaged before handover.
5.4 Packaging Requirements The Sender is solely responsible for ensuring that the parcel is adequately and securely packaged before handover. Packaging requirements include: Covering the goods completely and securing all ends with strong packing tape. For fragile items, wrapping in bubble wrap with corners and edges well protected. Using stretch wrap for items that may shift during transit. For boxed items, filling void spaces with crumpled paper or cushioning material. Using strong shipping tape such as pressure-sensitive packing tape or water-activated tape. SHIPTER shall not be liable for any damage caused to goods due to inadequate or improper packaging by the Sender.
5.5 Parcel Size and Weight Limits Parcels must comply with DMRC regulations regarding size and weight. The maximum permitted dimensions are 60 cm × 45 cm × 25 cm and the maximum permitted weight is 45 kg. SHIPTER reserves the right to reject any parcel that exceeds these limits.
5.6 Receiver Availability The Sender must ensure that the receiver is available at the drop DMRC station at the time of delivery. If the receiver is unavailable or refuses to accept the parcel, the Sender shall remain liable for all delivery charges and any additional costs incurred.
5.7 Payment The Sender agrees to pay the delivery charge as displayed in the App at the time of booking. Payment may be made through the SHIPTER Wallet or Cash on Delivery, as selected at the time of booking. If Cash on Delivery is selected, the Sender must ensure that the receiver pays the full delivery charge to the Traveler Partner upon delivery.
5.8 Cancellation The Sender may cancel a Delivery Request before a Traveler Partner has been matched, without any cancellation fee. Cancellations made after a Traveler Partner has been matched may incur a cancellation fee as per SHIPTER's policies, which will be communicated at the time of cancellation.
6. TRAVELER PARTNER TERMS AND CONDITIONS
6.1 KYC Verification Traveler Partners must complete the KYC verification process before accepting any Delivery Requests. This includes submitting valid Aadhaar Card and PAN Card documents. SHIPTER reserves the right to reject any KYC application at its sole discretion.
6.2 Accuracy of Information Traveler Partners represent and warrant that all information provided during registration and KYC verification is true, accurate, and complete. Any false or misleading information shall result in immediate account suspension and may lead to legal action.
6.3 Route Compliance Traveler Partners must accept Delivery Requests only for routes that match their actual metro travel route as declared on the App at the time of accepting the request. Accepting Delivery Requests for routes that the Traveler Partner does not intend to travel is a violation of these Terms.
6.4 Parcel Handling Traveler Partners must handle all parcels with due care and diligence. Traveler Partners must not open, tamper with, damage, misappropriate, or otherwise interfere with any parcel entrusted to them. Any such act shall result in immediate account suspension, forfeiture of earnings, and may lead to civil and criminal legal action.
6.5 OTP Verification Traveler Partners must verify the parcel at the time of pickup using the OTP provided by the Sender through the App. Traveler Partners must not accept any parcel without OTP verification. Similarly, Traveler Partners must obtain delivery confirmation through OTP verification from the receiver at the time of delivery.
6.6 DMRC Compliance Traveler Partners must comply with all DMRC rules and regulations while carrying parcels on the metro, including but not limited to luggage size and weight restrictions, prohibited items policies, and general conduct requirements.
6.7 Restricted Items Traveler Partners must not carry any Restricted Items as specified in Section 8 of these Terms. If a Traveler Partner discovers or suspects that a parcel contains Restricted Items, they must immediately inform SHIPTER and must not proceed with the delivery.
6.8 Earnings and Platform Fee Earnings from completed deliveries shall be credited to the Traveler Partner's SHIPTER Wallet within 24 hours of successful delivery confirmation, after deduction of the applicable Platform Fee. The Platform Fee percentage is displayed in the App and may be updated from time to time. SHIPTER reserves the right to withhold earnings in case of disputes, complaints, or suspected fraudulent activity.
6.9 Withdrawal of Earnings Traveler Partners may request withdrawal of their SHIPTER Wallet balance to their registered bank account. All withdrawal requests are subject to admin approval and are processed within 1 to 2 business days of approval. SHIPTER reserves the right to reject withdrawal requests in case of suspected fraud or policy violations.
6.10 Account Responsibility All actions taken through the Traveler Partner's SHIPTER account shall be deemed to have been duly authorized by the Traveler Partner. The Traveler Partner is solely responsible for maintaining the confidentiality and security of their account credentials.
7. SHIPTER WALLET TERMS AND CONDITIONS
7.1 Wallet Facility SHIPTER provides a digital wallet facility to all registered users. The SHIPTER Wallet is a prepaid payment instrument that can be used to pay for delivery services and receive earnings from completed deliveries.
7.2 Adding Money to Wallet Senders may add money to their SHIPTER Wallet using Razorpay, which supports UPI, credit cards, debit cards, and net banking. The minimum top-up amount is INR 1 (Rupee One). All payments are processed securely through Razorpay's payment gateway.
7.3 Wallet Usage The SHIPTER Wallet balance can be used to pay for delivery services booked through the App. Wallet balance is non-transferable between users and cannot be used for any purpose other than paying for SHIPTER Services.
7.4 Earning Credits Traveler Partners receive delivery earnings in their SHIPTER Wallet after successful completion of a delivery, subject to deduction of the applicable Platform Fee. Earnings are credited within 24 hours of delivery confirmation.
7.5 Withdrawal Traveler Partners may withdraw their SHIPTER Wallet balance to their registered bank account. Withdrawal requests are subject to admin approval. The minimum withdrawal amount is INR 100 (Rupees One Hundred). There are no charges for withdrawals. Approved withdrawals are processed within 1 to 2 business days.
7.6 Refunds In the event of a failed or cancelled delivery where the Sender has paid through the SHIPTER Wallet, the delivery charge will be refunded to the Sender's SHIPTER Wallet within 7 to 10 working days of the claim being accepted by SHIPTER, subject to submission of complete documentation.
7.7 Wallet Expiry SHIPTER Wallet balances do not expire as long as the user's account remains active. Upon account deletion, any remaining wallet balance will be forfeited unless a refund request is submitted prior to deletion.
7.8 Fraud Prevention SHIPTER reserves the right to freeze, suspend, or terminate a user's SHIPTER Wallet in case of suspected fraudulent activity, misuse, or violation of these Terms. SHIPTER shall not be liable for any loss arising from such action.
8. RESTRICTED ITEMS
The following items are strictly prohibited from being sent or carried through the SHIPTER platform ("Restricted Items"). Senders must not book any consignment containing, and Traveler Partners must not carry, any of the following:
Pornographic or obscene materials of any kind. Dry ice or any cryogenic substances. Human body parts, human remains, or human ashes. Explosives, detonators, or explosive devices of any kind. Firearms, ammunition, or any weapons. Flammable liquids, gases, or solids. Livestock, pets, or live animals of any kind. Dangerous goods or hazardous materials as defined under applicable law. Illegal goods or contraband of any kind. Radioactive materials or nuclear substances. Precious jewellery, gemstones, or precious metals. Currency notes, coins, or negotiable instruments. Gambling devices or lottery tickets. Fire extinguishers or pressurized containers. Cigarettes, tobacco products, or alcohol. Narcotics, controlled substances, or illegal drugs. Compressed, liquefied, or dissolved gases under pressure. Acids, corrosives, or other chemically reactive substances. Carcasses of dead animals or any decayed organic matter. Plants, seeds, or manure of any kind. Secure documents including passports, Aadhaar Cards, PAN Cards, bank statements, credit cards, debit cards, or bank cheques. Any item declared as dangerous or prohibited by DMRC or SHIPTER from time to time. Any item that is illegal under applicable Indian law.
SHIPTER has a zero-tolerance policy towards the use of its platform for transportation of illegal or prohibited items. In the event of mis-declaration of goods, the Sender shall be solely liable for all consequences, including legal liability, and SHIPTER shall have no liability whatsoever. SHIPTER reserves the right to report any suspected illegal activity to law enforcement authorities.
9. LIABILITY AND INDEMNIFICATION
9.1 Limitation of Liability SHIPTER's liability for any loss or damage to a parcel directly attributable to SHIPTER or its Traveler Partners shall be limited to ten times the delivery charge paid or payable for that delivery, provided that the amount so calculated shall not exceed the declared value of the goods.
9.2 Insurance For parcels with a declared value exceeding INR 1,500 (Rupees One Thousand Five Hundred), the Sender must obtain insurance coverage at their own cost. SHIPTER does not provide insurance coverage for parcels.
9.3 Exclusion of Consequential Damages Under no circumstances shall SHIPTER or any of its directors, officers, employees, agents, or contractors be liable for any indirect, incidental, consequential, special, or exemplary losses or damages, including but not limited to loss of income, profits, business, or data, arising from the use of or inability to use the SHIPTER Services.
9.4 Force Majeure SHIPTER shall not be liable for any failure or delay in performance of its Services due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, strikes, epidemics, pandemics, DMRC disruptions or metro closures, government orders, or any other force majeure event.
9.5 Indemnification by Sender The Sender agrees to indemnify, defend, and hold harmless SHIPTER and its directors, officers, employees, agents, and contractors from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: The Sender's breach of these Terms. The Sender's mis-declaration of parcel contents. The Sender's violation of applicable law. Any third-party claims arising from the Sender's use of the Services.
9.6 Indemnification by Traveler Partner The Traveler Partner agrees to indemnify, defend, and hold harmless SHIPTER and its directors, officers, employees, agents, and contractors from and against any and all claims, damages, losses, costs, and expenses arising out of or in connection with: The Traveler Partner's breach of these Terms. The Traveler Partner's negligent or wrongful handling of parcels. The Traveler Partner's violation of DMRC rules and regulations. Any third-party claims arising from the Traveler Partner's use of the Services.
10. CLAIMS AND DISPUTE RESOLUTION
10.1 Claims for Loss or Damage Any claim for loss or damage to a parcel must be made in writing within 24 hours of the date of delivery or expected delivery. Claims must be submitted to dhneshwar3079@gmail.com with photographs of the damaged goods and a description of the damage. Claims submitted after this period will not be ordinarily processed.
10.2 Refund Claims When claiming a refund for damaged goods, the Sender must verify their identity as the original Sender of the goods. SHIPTER may request additional information to validate the identity of the claimant. If identity cannot be validated, the refund request will not be processed.
10.3 Invoice Discrepancies Any discrepancy in invoice value must be brought to SHIPTER's attention within 7 days of the completion of the transaction. Requests submitted after this period will not be ordinarily processed.
10.4 Mediation Any disputes between SHIPTER and users that cannot be resolved amicably within 30 days from the date of the dispute may be referred to mediation in accordance with applicable Indian law. A neutral mediator shall be appointed to facilitate the mediation process. The parties shall keep the mediation proceedings confidential.
10.5 Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of India. Subject to the mediation clause above, the courts in NIT Faridabad, Haryana shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
11. ACCOUNT SUSPENSION AND TERMINATION
11.1 Suspension by SHIPTER SHIPTER reserves the right to suspend or terminate any user's account at any time and for any reason, including but not limited to: Violation of these Terms or any other SHIPTER policies. Provision of false or misleading information during registration or KYC. Fraudulent activity or misuse of the platform. Repeated complaints from other users. Non-compliance with applicable law. Any activity that poses a risk to the safety or security of other users or the platform.
11.2 Effect of Termination Upon termination of your account, your right to use the SHIPTER App and Services will immediately cease. Any pending deliveries will be cancelled, and any wallet balance may be forfeited depending on the reason for termination.
11.3 Termination by User You may terminate your account at any time by contacting SHIPTER at dhneshwar3079@gmail.com. Upon termination, your personal information will be deleted in accordance with our Privacy Policy, subject to retention requirements.
12. PROHIBITED CONDUCT
Users of the SHIPTER platform are prohibited from engaging in the following activities:
Using the platform for any unlawful purpose or in violation of applicable law. Providing false, inaccurate, or misleading information. Impersonating any person or entity. Using fake or mock GPS location applications to circumvent location verification. Creating multiple accounts to circumvent bans or restrictions. Attempting to hack, reverse engineer, or otherwise compromise the security of the App. Using the platform to harass, threaten, or harm other users. Engaging in any fraudulent activity, including false delivery confirmations. Attempting to circumvent SHIPTER's payment systems. Uploading or transmitting any malicious code, viruses, or harmful content. Violating any DMRC rules or regulations while using the Services.
13. INTELLECTUAL PROPERTY
All intellectual property rights in the SHIPTER App, including but not limited to trademarks, logos, software, design, and content, are owned by or licensed to SHIPTER. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for the purpose of accessing and using the Services in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the App or its content without SHIPTER's prior written consent.
14. MODIFICATIONS TO SERVICES
SHIPTER reserves the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice. SHIPTER shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
15. GRIEVANCE OFFICER
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, the details of the Grievance Officer are as follows:

Any grievances or complaints may be directed to the Grievance Officer. We will endeavor to address your grievance within 30 days of receipt.
